Valuation Of Stock Shares In A Divorce Case For Equitable Distribution

In a recent opinion issued in the Tucker v. Tucker case, the Fourth District Court of Appeals reversed the ruling of a trial court which had set the value of the marital stocks at the average of what the Husband and Wife claimed them to be without hearing the parties evidence in support of their valuations.

Stock valuation can be an important issue in a divorce case for equitable distribution purposes.  Sometimes stocks can be considered premarital, sometimes marital and there can be an issue as to commingling or an increase in their value during the marriage as a result of marital efforts even if they were premarital.  In such circumstances you need the help of an attorney and forensic accountant to make sure the stocks are properly valued and classified in your case and the appropriate evidence is presented to the court.
