Every year thousands of people are bitten by dogs in the United States.  Only a small proportion of these dog attacks result in the death of the victim but many lead to severe injuries, surgery, and scarring. While dogs can make great pets depending on their breeding and training they can also cause horrific injuries when they go on the attack.

Florida imposes strict liability on dog owners for dog bites whether the dog had a dangerous propensity or not and whether or not the owner knew of the dangerous propensity of their dog or not.  Florida Statute 767.04 applies whether the victim is in a public place or lawfully on private property when bitten by the dog.  The statute allows for comparative fault to apply where the victim was themselves negligent and that negligence was a contributing cause of their dog bite injury.

A person is lawfully on private property when the person is on the property to perform a duty imposed by law or when expressly or implicitly invited by the owner.  However, except as to a person under 6, or unless there was negligence by the dog owner, a prominent Bad Dog sign on private property can relieve the owner of the strict liability imposed by the statute.
